## 3.1 How residential parking works in Cluj-Napoca (2026)

### The rule that applies

### Transfer when the apartment is sold (the key point)
- [Verified] City-built neighbourhood spots: "Abonamentele de parcare sunt valabile numai pentru autoturismele cu numerele de înmatriculare pentru care sunt eliberate, acestea nefiind transmisibile." ### Waiting lists, enforcement, plans

## 3.2 What "loc de parcare cu abonament" most likely means

### What the ad says
- [Verified] The ad text (Storia copy) says only: "...dispune de incalzire prin centrala termica proprie, loc de parcare cu abonament, se vinde mobilata, utilata." No spot number, no price for the spot, no CF, no garage. ### The options, ranked
1. **[Likely — most probable] A city neighbourhood subscription (surface spot, HCL 412/2020 Chapter I) in the current owner's name.** "Abonament" is the official word for exactly this. 3. **[Possible, less likely] A "contract de închiriere a terenului" for a spot/carport built by residents under a building permit (Chapter II).** People often also call this "abonament". Fee 75 lei/year (carport/garage) or possibly 94 lei (open spot). This one **can be transcribed** to the buyer with the seller's notarised consent, if the buyer lives in an adjacent building and owns a car (Art. 20). 4. **[Unlikely] A private rental** from a third party (e.g. an owned underground spot or garage). Private rentals are usually called "închiriat", not "abonament", and would end with the seller anyway. — basis: wording; market listings (see 3.3)

### Proof to ask for (before any arvună)
- Copy of the current **abonament** or **contract de închiriere teren** (2026), with holder name, car plate, car park/street, **spot number**, and validity.
- The **2026 payment receipt / invoice** (the tariff 94 / 165 / 75 lei is a hint to the type) and the **title of the document** ("abonament" vs "contract de închiriere a terenului").
- For a multi-level parking: the access card and which parking.
- A **written statement** from the seller (and agency) on what exactly is sold: "the spot is / is not transferable; seller will / will not sign a notarised consent for transcription (Art. 20 HCL 412/2020)".

## Parking verdict (draft)
The ad's "loc de parcare cu abonament" is almost certainly a city resident subscription in the seller's name. Under HCL 412/2020 (amended by HCL 32/2021 and HCL 778/2024) it is tied to the seller and their car. It cannot be sold or handed over with the flat, so it ends the 31 March after the seller moves out. The buyers would start at the back of a first-come queue, after they change their ID address to the flat. Mănăștur has one of the worst shortages in Cluj, and the city publishes no waiting times, so a spot could take years. A second car is very unlikely to get one. There are three city parkings 300-450 m away (165 lei/year), but they use the same queue. Only one private spot was for rent in all of Mănăștur on 31 Oct 2026 (~250 lei/month), and none was for sale. For a must-have, this flat **does not come with a reliable spot**. Treat the parking as worth zero unless the seller proves in writing, with documents, that the spot can legally pass to the buyers. That is only possible for a spot or carport that residents built under a building permit and that runs on a land-rent contract ("contract de închiriere a terenului"), not an "abonament". Otherwise, either budget a private rental or the purchase of a transferable spot (about 10,000 €), and use that in the price talks, or walk away.

- What exactly is the "loc de parcare cu abonament"? Is it (a) a city subscription for a surface spot, (b) a place in a city parking (which one), or (c) a land-rent contract for a spot or carport that residents built under a building permit?
- Please send a copy of the 2026 subscription or contract and the 2026 payment receipt. (Is the document an "abonament" or a "contract de închiriere a terenului"? 165 lei = city parking; 75 lei = carport/garage on contract; 94 lei = open spot.)
- Will you state in writing that the spot passes to the buyer? Under which article of HCL 412/2020?
- Is the asking price the same with and without the spot? If the spot cannot pass, why does the title say "parcare"?
- What is the exact address and block? (This decides which car park and parking the block is assigned to.)

- Whose name is the subscription in, and for which car (plate)? Since which year? How long did you wait for it?
- Where is the spot (car park, spot number)? Is it numbered and marked?
- If it is a citizen-built spot or carport (Chapter II): do you have the building permit, the site plan and last year's contract? Will you sign the notarised consent for the transfer at closing? Can we put this in the antecontract as a condition?
- Do you know of any garage or spot near the block that is for rent or for sale?
- At night, can you usually find a legal unnumbered space near the block after 20:00?

- How many numbered spots does the car park next to the block have, and how many flats? Do neighbours wait for spots, and for how long?
- Does the block own any parking land of its own (rare for 1970s blocks)?
- Do you know of planned works that remove spaces: metro station on Str. Primăverii, car park redesign, garage demolition, green-space projects?
- Has anyone in the block got a new city spot in 2025 or 2026?

## Red flags
- **deal-breaker** — There is no proof that the spot can legally pass to the buyers. A city subscription is personal and plate-bound (HCL 412/2020 Art. 6, 8). For a must-have, this alone fails the requirement unless the seller proves it is a transferable Chapter II contract.
- **negotiate** — The ad sells "parcare" as a feature, but most likely it has zero transfer value. Use ~10,000 € (a Mănăștur spot sold with another flat), or ~3,000 lei/yr private rent, as the price gap versus flats with a real spot.
- **negotiate** — The waiting time is unknown and probably years. City-wide demand is huge: 14,185 requests in 2022, plus carried-over unsolved requests every year.

- **Waiting-list numbers for Mănăștur or for each car park**: not published. I checked the city parking pages, the parking announcements page, news (Actual de Cluj, Monitorul de Cluj, Cotidianul) and the 2022 debate minutes. How to check: after choosing the flat, ask Direcția Parcări publice (str. Moților nr. 7, or a written request under Legea 544/2001) for the number of unsolved requests for the car park and parking assigned to that block. - **List of blocks assigned ("arondate") to each parking**: the parking chief mentioned a council decision in Dec 2022, but I could not find its number.
